Description

The Public Guardianship Office (PGO) is the administrative arm of the Court of Protection and part of the Department for Constitutional Affairs. It took over the mental health functions previously undertaken by the Public Trust Office (which also included the work of the Court Funds Office and Trust Division). It is responsible for providing services that promote the financial and social well being of people with mental incapacity.

The PGO provides financial protection services for clients who are not able to manage their financial affairs because of mental incapacity. The incapacity may be related to an illness suffered by some older people (e.g.dementia), or the result of an accident or negligence (brain injury) or of mental illness (schizophrenia). Some people with learning difficulties may also be clients of the PGO. They are here to support the families and advisers of the person who is incapable, often after someone has applied to the Court of Protection to manage the incapacitated person's financial affairs.

The OPG is an agency of the Ministry of Justice. The head of the OPG is the Public Guardian who is responsible for:

Supervising Deputies appointed by the Court of Protection to make on going decisions on behalf of a person who lacks capacity to make particular decisions for themselves.

Keeping registers of Deputies, Lasting Power of Attorneys (LPAs) and Enduring Power of Attorneys (EPAs).

Investigating representations including complaints about Deputies and Attorneys acting under registered LPAs or EPAs.
